Course Description
Virtually all lawyers negotiate on behalf of their clients, and all of us negotiate on occasion on behalf of ourselves or our friends and family. Nearly everyone can become a better negotiator with training. This course provides opportunities to obtain experience through simulations (role-playing) in a wide variety of legal and legal/business contexts. These include neighborhood disputes, sale of a motor vehicle, division of the assets of an estate, a wrongful termination law dispute, transfer of real estate, manufacturing of goods to order, sale of a business, negotiation of salary and benefits by a prospective law firm associate, settlement of a personal injury suit, a criminal law plea bargain, and a labor-management dispute. While much of the learning (and most of the time devoted) comes from the simulations, there is some related reading and class discussion.

A portion of the course deals with cross-cultural negotiation and students in the foreign LL.M. program, in one of our foreign exchange programs, or with other extensive foreign experience are particularly welcome.

Please note: the course schedule blocks out additional time. This is done to provide sufficient time to carry out the simulations during class time. However, the total time actually spent in class will not exceed the amount for a more traditional three credit course.

Method of Evaluation: Students are graded primarily on 10-14 different written assignments, class presentations, quizzes, graded taped negotiations and class participation. There is no final. It is graded on an Honors/Pass/Fail basis.
