LAW585  A  SOCIAL MEDIA AND THE LAW

Course Description
This course provides a comprehensive look at how social media is affecting the legal system. Using a combination of trial and appellate cases along with other reading, the course examines the myriad of ways in which information from sites like Facebook, MySpace, Twitter, and from the " blogosphere" is being used nationwide in various areas of legal practice including, but not limited to, criminal, family, employment, and personal injury law. The course will not only explore discoverability and evidentiary issues involving social media content, but also will consider how traditional notions and norms in areas such as civil procedure, legal ethics and constitutional law are being impacted. The implications of social media use by other participants in the legal system, such as judges and jurors, will also be covered. Finally, the course will take a look at the novel issues arising as a result of attorneys using social media for marketing. The course ultimately will not only provide insight into social media's impact on the legal system, but also will consider best practices that may be adopted to competently navigate the evolving nature of social media and the practice of law.
