Course Description
This course aims to provide an overview of and insight into some of the essential practical skills for lawyers. It starts by examining the importance of cogent narrative as the bedrock of an adversarial system beginning with witness evidence and continuing to judgments. It will look at the skills required for effective witness handling from taking detailed instructions from clients to court room tactics and cross examination. We then turn to look at what makes an excellent legal brief encompassing skills required for legal research including comparative law analysis, drafting skills, style and syntax. There will be a class on ethics and law and how in practice these may be resolved whether ethics relating to client confidentiality issues, colleagues at work, conflicts of interest, and duties owed to the Courts. We will also examine the issue of legal culture and how that affects the way in which cases are handled from the perspective of client relations, presentation of witness evidence, client relations, the judiciary and court room behaviour. Finally we shall have a class on advocacy with an opportunity for students to conduct a mini moot court with students taking on the roles of advocates for all parties and the judges. The course materials will be taken as far as possible from real examples of cases and issues in practice.

Professor Samantha Knights is a guest lecturer for this course.
