LAW223  AS  ALTERNATIVE DISPUTE RESOLUTION

Course Description
A practical, hands-on introduction to alternatives to litigation as a means of resolving disputes. Half the course deals with negotiation, a skill needed by all lawyers. Other alternatives such as mediation, arbitration, and court-sponsored dispute resolution techniques will be covered in the other half. A majority of the classroom time will be devoted to simulated negotiations and mediations using role-playing techniques. The course also covers theoretical, legal and ethical issues in negotiation, mediation and arbitration. The class will not meet some scheduled sessions to allow enough time to carry out the simulations during class time. While preparation for and participation in the simulations can be time-consuming, the reading load is about the same as for one and a half credits. Foreign LL.M. and exchange students are particularly welcome. Please note that on two occasions some students will have activities scheduled over the lunch break. This course is designated Honors/Pass/Fail.

Method of Evaluation: Three short tests, one graded negotiation, four or more written exercises, one oral presentation, two “journals”, class participation, peer review. No final.

Special Restrictions: Students cannot receive course credit for both ADR and the three credit Negotiation course. Cannot be taken the same semester as Litigation Skills
