LAW213  A  ENVIRONMENTAL LAW

Course Description
This introductory course introduces main concepts of environmental protection, along with administrative law and judicial review in the environmental arena. After considering the major constitutional hurdles in regulation of environmental law (with a focus on justiciability doctrines), we will examine major federal environmental statutes including the National Environmental Policy Act, Clean Water Act, Clean Air Act, and Endangered Species Act. We will investigate both the emergence of environmental regulation in these areas and the newly evolving remedies for the control of pollution and prevention of environmental degradation.

  • Assignment: There are 2 readings for the first class. From the Environmental Regulation textbook required for the course, read pages 3-19. Additionally, we will be reading pages 17-31 of Environmental Law and Policy by James Salzman and Barton Thompson. This book is available for free online through the law library website. Go to https://www.law.miami.edu/iml/library Look for Quick Links and below, you will see the list for "West Academic Study Aids" You can also try this link directly: https://daytona.law.miami.edu:2087/ From there, I think the easiest may be to just type "Salzman" into the search bar and it should be the first book that comes up. We are reading Environmental Law and Policy (not the Natural Resources Law book). If you have trouble getting this to work, you may need to be on campus or logged in via a proxy server.
