LAW936  DL  THE LAW OF FORCE MAJEURE: THE IMPACT OF THE PANDEMIC ON SPORTS AND ENTERTAINMENT

Course Description
This summer course will be taught online over nine (9) weeks from mid-May through mid-July. The course will meet weekly (live) via Zoom. The course will be facilitated by Peter Carfagna and Myles Pistorius (with assistance from Greg Levy) and will include discussions from industry leading experts each week based on the particular sport and entertainment industry sectors covered. Throughout the course, we will also discuss the CARES act and its impact on the entertainment and sports industries.

This course begins by framing the law of force majeure. It will look at how force majeure clauses have been drafted, how courts have interpreted different language and how these clauses may change moving forward in light of COVID-19. Next the course will examine how unavoidable business interruption insurance operates in times of pandemics. Finally, the course will explore specific examples of how the entertainment and sports industry has been impacted.
Throughout the course, students will be assigned drafting and practical exercises.
