LAW806  BS  COVID -19: LAWYERING IN A PANDEMIC EXPERIENTIAL PROJECT

Course Description
Students will work with Professor Jacobowitz and the Miami-Dade Commission on Ethics and the Public Trust (COE) to explore the general impact of the pandemic on the functioning of a public ethics entity, but more specifically consider the fact that this Commission needed an emergency order from the governor to be able to meet by Zoom because of the Miami-Dade County's interpretation of the Florida's Sunshine laws. (Prior to Covid 19, an ethics commissioner could not even appear by phone at any meeting.)

The project will likely include a survey of other county/government entities' pre-pandemic policies, proposed modifications for the post-pandemic world, amendments to the interpretation of the Florida Sunshine laws and Public Records act that would maintain protection and transparency for the public, but allow for greater efficiency in government, etc.

Another project may explore the tension between a political incumbent's First Amendment rights to interact with constituents and the impermissible use of office or title for political gain during a crisis. In other words, when does an government official's crisis messaging cross the line into an impermissible use of his political office and stature?

Students will learn about government codes of ethics, sunshine laws, the public records act in order to propose policy changes and develop a white paper for future use. The project will be co-supervised by Professor Jacobowitz and the COE Director or one of the other COE attorneys.
