Course Description
|
This course will review three areas of constitutional law: Substantive Due Process, Equal Protection and the First Amendment. We will also look at some present day issues, especially if the Supreme Court decides cases related to the election.

Please read the attached Syllabus.
First Assignment: Please read the U.S. Constitution, CB lix-lxxiii, Two proposals to Amend the U.S. Constitution, (attached), and the Introduction and Overview of Freedom of Speech, CB 931-946.
We will start with the Freedom of Speech Section as listed in the Syllabus. If you have the time and inclination, read Schenk, Frohwerk, and Debs, CB 946-950, 954 (Note 1 and first paragraph of Note 2). We will probably not reach those cases until at least the second class.
After we finish Brandenberg v. Ohio, I will have you do a short essay on whether the statements by President Trump are protected speech or can be used to prosecute him for violation of a statute making seditious conspiracy a crime. Documents will be sent to you by email later during the semester.
