Course Description
This course will examine the role of the federal courts in the American governmental structure-including the relationship of the federal courts to: (1) other branches of the national government; and (2) state court systems. Likely topics to be covered in this course include justiciability (standing, ripeness, mootness and political questions); the power of Congress to define the jurisdiction of the federal courts, including its power to create non-Article III courts; the subject matter jurisdiction of the federal courts; the appellate jurisdiction of the U.S. Supreme Court and federal Courts of Appeal; judicial abstention; federal common law; state sovereign immunity; 42 U.S.C. ยง 1983; and habeas, including recent cases arising from the "war on terror."
