LAW508  A  THE LAW OF CREATIVITY

Course Description
Intellectual property law has long been primarily understood in either economic terms (as a solution to underinvestment in public goods) or Lockean ones (as rights that creators deserve). Recent scholarship—and a long judicial tradition—instead frames IP law in psychological and sociological terms as the law of creativity. The idea is that there is a set of social practices that we label “creative” and the law exerts an important influence on those practices. In this seminar, we will explore the key insights generated and questions raised by this recent scholarship.

The class will meet once a week for two hours to discuss a set of assigned readings. Students will be required to provide weekly reaction papers that respond to those readings. Because this is a discussion-based class, participation is required and will be the basis for a significant percentage of each student’s grade.
