A REPRESENTING THE PROFESSIONAL ATHLETE

Course Description
|
This course will provide students with an understanding of what a career as a sports agent/attorney for a professional athlete entails. The class will start with the problems an agent/attorney confronts when helping an athlete “go pro.” From there, we will discuss the agent’s fiduciary duty to his client and proceed to discuss some of the more important legal doctrines relating to the athlete-representation profession, involving intellectual property law, labor law, and contract law. In that context, the course will explore the skills necessary to conduct a series of “hypothetical” sports-related contract negotiations. The students will then participate in contract-drafting exercises with an emphasis on client representation. Contracts to be drafted include a “product endorsement agreement,” and a “name, image and likeness” lithograph poster agreement. Also, agent/client representation agreements and agent/agency employment agreements will be examined. After “drafting” various agreements, in the context of a mock litigation, students will assume a “contract breach” of the agreements that they have drafted. In turn, they will draft brief headings and litigation-related documents in support of the contractual positions taken during the contract drafting exercises. Short Course Attendance Policy Due to the small number of meetings, attendance to all meetings/classes for short courses is mandatory. Students who miss more than one class session (80 minute) of a 1-credit short course are subject to administrative withdrawal and will have a W for the course on their transcripts.
